Family Provision Application

Certain classes of beneficiaries or potential beneficiaries may contest your Will if they believe they have not been properly provided for.  They include;

  • Your spouse;
  • Your children (including stepchildren and adopted children);
  • A person who is financially dependent on you;
  • The parent of your infant child

A Will reflects your last wishes as to how your assets are to be distributed after your death.  There are many reasons why you may wish to provide for, or not provide for, to the same extent, of any of the above stated class of beneficiaries.

It is important to note that when someone is contesting an Estate because they have not been properly provided for, they are contesting the distribution of the Estate, not the validity of the Will itself.

It is important to discuss this matter to your solicitor when drafting your Will as they can explain the potential consequences of not making provisions for the above stated people.
